By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service" or "Terms"), including any additional terms and conditions and policies referenced herein. These Terms apply to all users of the site, including browsers, customers, merchants, and contributors of content.

Your content (excluding credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer.

We reserve the right to limit sales of our products to any person, geographic region, or jurisdiction, and to limit quantities of any products or services we offer. Product Disclaimers

Sol Brush SPF 50: Sol Brush SPF 50 is an over-the-counter (OTC) sunscreen drug product regulated by the U.S. Food and Drug Administration (FDA). It is not intended to diagnose, treat, cure, or prevent any disease other than sunburn. Always use as directed. Apply 15 minutes before sun exposure and reapply at least every 2 hours, or after 80 minutes of swimming or sweating, or immediately after towel drying. Sol Brush is water resistant for 80 minutes. No sunscreen product provides 100% protection. See the product Drug Facts label for complete usage directions and warnings.

Bug Brush by Sol Brush: Bug Brush is a natural insect repellent. It is not intended to prevent, treat, or cure any mosquito-borne or tick-borne disease, including but not limited to Zika virus, West Nile virus, dengue fever, or Lyme disease. Bug Brush is not FDA-approved and is not a drug. Do not apply near eyes or mouth. Do not use on children under 6 months of age.

General: Product results may vary. Testimonials and reviews displayed on this site reflect the individual experiences of real customers and are not intended to represent or guarantee that anyone will achieve the same or similar results. Individual results depend on a variety of factors.

Section 6 — Accuracy of Billing and Account Information

We reserve the right to refuse any order. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. If we make a change to or cancel an order, we will attempt to notify you via the email or billing address provided at the time of the order.

You agree to provide current, complete, and accurate purchase and account information for all purchases. For more details, please review our Return and Refund Policy.

Section 7 — Subscription Billing Terms

Sol Brush offers subscription programs including "Subscribe and Save" and "Summer Sun Pack" managed through our subscription provider, Appstle. By enrolling in a subscription, you acknowledge and agree to the following:

Pricing and Billing Frequency:

• Subscribe and Save: You will be charged automatically each month at a 20% discount off the retail price. The exact amount will be displayed at checkout before you complete your purchase. Billing continues each month until you cancel.
• Summer Sun Pack: You will be charged automatically each month for six consecutive months at a 25% discount off the retail price. The exact amount will be displayed at checkout before you complete your purchase. Summer Sun Pack subscriptions renew annually on March 1st unless cancelled before that date.

How to Cancel: You may cancel your subscription at any time after your second shipment by emailing hello@solbrush.com or by managing your subscription directly in your account portal at solbrush.com. Cancellations take effect at the end of your current billing cycle with no penalty. For Summer Sun Pack subscribers, cancel before March 1st to avoid annual renewal.

Subscription Terms Are Separate: Your consent to subscription billing terms is separate from your agreement to these Terms of Service. You will be asked to provide separate, affirmative consent to the subscription billing terms, including the price, frequency, and cancellation method, before your subscription begins.

Section 8 — Optional Third-Party Tools

We may provide access to third-party tools over which we have no control or input. Access to such tools is provided "as is" and "as available" without any warranties or endorsement. Any use of optional third-party tools is entirely at your own risk and discretion.

Third-party links on this site may direct you to third-party websites not affiliated with us. We are not responsible for the content, accuracy, or practices of third-party websites, and we have no liability for any third-party materials, products, or services. We are not liable for any harm or damages related to purchases or transactions made in connection with any third-party websites.

If you send creative ideas, suggestions, proposals, or other materials to us (collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, and translate those comments in any medium. Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

Section 13 — Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content for any unlawful purpose; to solicit others to perform unlawful acts; to violate any international, federal, state, or local regulations, rules, or laws; to infringe upon or violate our intellectual property rights or the rights of others; to harass, abuse, insult, harm, defame, discriminate against, or intimidate any person or group; to submit false or misleading information; to upload or transmit viruses or any other malicious code; to collect or track the personal information of others; to spam, phish, scrape, or crawl; or to interfere with or circumvent the security features of the Service or any related website.

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

All content on this website, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Brand 2022b LLC (doing business as Sol Brush) or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. "Sol Brush," "Bug Brush," and related logos and product names are trademarks of Brand 2022b LLC. You may not use, reproduce, modify, or distribute any of our trademarks or copyrighted material without our prior written consent.

Section 15 — Disclaimer of Warranties and Limitation of Liability

We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free. We do not warrant that results obtained from the use of the Service will be accurate or reliable.

The Service and all products delivered through it are provided "as is" and "as available" without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Sol Brush, Brand 2022b LLC, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, loss of data, or replacement costs, arising from your use of the Service or any products procured using the Service, however caused and under any theory of liability, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

Section 16 — Indemnification

You agree to indemnify, defend, and hold harmless Sol Brush, Brand 2022b LLC, and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Section 17 — MANDATORY BINDING ARBITRATION AND CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Agreement to Arbitrate

You and Sol Brush (Brand 2022b LLC) agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any products purchased through the Service (collectively, "Disputes") will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

Class Action Waiver

You and Sol Brush agree that any Disputes will be resolved on an individual basis only, and not on a class, consolidated, or representative basis. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration. Neither you nor Sol Brush may be a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class, consolidated, or representative proceeding.

Arbitration Rules and Procedures

Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. If AAA is unavailable, the parties will mutually select an alternative arbitral forum. Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules.

The arbitration will be conducted in Dallas, Texas, unless you and Sol Brush agree otherwise or the AAA rules provide otherwise. The arbitrator shall apply Texas substantive law (without regard to conflict-of-law principles). The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Opt-Out Right

You may opt out of this arbitration and class action waiver provision by sending written notice to Sol Brush within thirty (30) days of your first purchase from solbrush.com. Your opt-out notice must be sent to: Brand 2022b LLC, Attn: Legal — Arbitration Opt-Out, hello@solbrush.com. Your notice must include your full name, mailing address, email address, and a clear statement that you wish to opt out of the arbitration and class action waiver provision. If you opt out, all other provisions of these Terms will continue to apply.

Exceptions

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

Severability of Arbitration Provision

If any portion of this Section 17 is found to be unenforceable, the remaining portions shall remain in full force and effect. If the class action waiver is found to be unenforceable, the entire Section 17 shall be deemed void (but all other sections of these Terms shall remain in effect), and any Dispute shall be resolved in accordance with Section 19 (Governing Law).

Section 18 — Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms without affecting the validity and enforceability of any other remaining provisions.

Section 19 — Termination

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If, in our sole judgment, you fail or we suspect you have failed to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination.

Section 20 — Entire Agreement

These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us, and govern your use of the Service. They supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

Section 21 — Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. Any litigation that is permitted under these Terms (including matters not subject to arbitration under Section 17) shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of such courts.

Section 22 — Mobile and SMS Terms of Service

The Sol Brush mobile message service (the "SMS Service") is operated by Brand 2022b LLC, doing business as Sol Brush. Your use of the SMS Service constitutes your agreement to these Mobile Terms. We may modify or cancel the SMS Service or any of its features without notice. Your continued use following the effective date of any changes constitutes your acceptance of such changes.

Consent: By consenting to Sol Brush's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Sol Brush through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

No Purchase Required: You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Sol Brush.

Costs: We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details.

Opt-Out: You may opt out of the SMS Service at any time. Text the single keyword command STOP to +18332623071 or click the unsubscribe link (where available) in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Sol Brush mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

Changes: We may change any short code or telephone number we use to operate the SMS Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

Carrier Liability: The wireless carriers supported by the SMS Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

Limitation of Liability: To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS Service, any errors in such information, or any action you may or may not take in reliance on the information or SMS Service.

Section 23 — Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of our website or the Service following the posting of any changes constitutes acceptance of those changes.
